*****Primary Areas of Practice*****

Statewide Real Estate or Property Disputes

One of the primary areas of our practice involves property disputes. This may involve Specific Performance — where a buyer or seller unreasonably fails to complete the transaction. We handle these matters regularly and are not hesitant to go to trial when that course of action is in the client’s best interests. Sometimes, a sale falls through and there is a battle about how the escrow should be disbursed. We also routinely help clients with  escrow disputes.  At times, two or more people may own a property, one wants to sell, the other wants to keep it. Occasionally, the only way to resolve this type of dispute is through litigation. This is known as partition and is covered more below.

Our team is geared to help you with real estate disputes, and remember, the initial consultation — with an experienced attorney — is free. Call or click the link to set up a convenient time to get the answers you need to your property disputes.

Partition — judicial involvement to resolve co-owned property disputes

In short, a Partition is a lawsuit asking the court to order the sale of jointly owned property. Partition actions are common where a parent dies and leaves property to two or more siblings. One wants to sell, one wants to keep, and they cannot agree. The one that wishes to sell brings a partition action asking the court to order a sale so the proceeds can be fairly divided. Partition is covered by statute in Florida, and certain attorneys’ fees can sometimes be recovered from the proceeds of a partition sale.

We have handled several partition actions and no two are the same. We always work hard and smart, and that is equally true regarding partition actions. Our firm effectively and efficiently analyzes the relevant facts and documents, including receipts for money spent on the property; we then quickly assess the case’s strengths and weaknesses. We file partition actions and we represent defendants in partition lawsuits. We write demand letters and we write responses to demand letters. In short, we are prepared to litigate when appropriate, and we are equipped to negotiate when that approach is more effective.

We bring our proven boutique approach to our partition clients. Our clients do not deal with layers of gatekeepers – secretaries, assistants, paralegals. Our clients communicate directly with their attorney. We strive to be direct and responsive. We understand that our clients do not want to wait, they want answers.

Civil Theft

Our team is well-versed and experienced in Civil Theft claims. If someone retains your money or property and refuses to return it, you may be entitled to triple damages if you prevail in court under a Civil Theft Claim.

Civil Theft is covered by statute in Florida, and a number of highly technical factors — including the timing and content of the mandatory demand letter — can determine whether the outcome. If you prevail in the civil theft lawsuit, the court may order your opponent to reimburse you for part or all of your attorney fees and court costs.

We handle Civil Theft Claims and have found that no two are the same. Sometimes a properly drafted demand letter can lead to a very cost-effective resolution. We always work hard and smart, and that is equally true regarding Civil Theft Claims. Our firm effectively and efficiently analyzes the relevant facts and documents, including an analysis of the elements of proof; we then quickly assess the claim’s strengths and weaknesses and devise a strategy.

We bring our proven boutique approach to our Civil Theft clients. This means our clients do not deal with layers of gatekeepers. We understand that our clients do not want to wait, they want answers. Breach of Contract

Our team has vast experience in Breach of Contract cases. If someone or some company claims you owe them a certain amount of money, and you disagree, that is a classic example of a contract dispute. If someone or a company promised to do something and did not even though they took your money, it is likely a breach of contract. In essence, any disagreement between two people, between one person and a company, or between two companies that is based on an agreement, whether in writing or oral, is a contract dispute.

When it comes to contract breaches, we file lawsuits and we defend lawsuits. We write demand letters and we write responses to demand letters. In short, we are prepared to litigate when appropriate, and we are equipped to negotiate when that approach is more effective.

We bring our proven boutique approach to our Breach of Contract clients. This means our clients do not deal with layers of gatekeepers. We understand that our clients do not want to wait, they want answers. We provide efficient and responsive representation. If you believe that someone has breached a contract and you have been harmed, we would suggest you call or click the scheduling link to set up a convenient time to talk to an attorney and get the answers you need.

General Civil Litigation

We like to tell clients and other friends of the firm that if we do not practice in a particular area, we probably know someone who does. We appreciate that certain highly technical legal questions can benefit from an attorney who specializes in that field. Our approach is different.  We know that the term Civil Litigation is broad and covers a vast number of legal areas; however, we enjoy the diversity of a boutique practice, focusing not on any one area of law, but focusing on the client.  If you believe that you could benefit from the involvement of our experienced team, we would encourage you to call or click the scheduling link to set up a convenient time to talk to an attorney and get the answers you need.

However, we do not practice Civil Rights law and do not currently have a recommendation for a lawyer in that area of law.
